Big Week for News

In preparation for what I would write about today, I started collecting some of the big stories. I don’t know when there has been so much big news happening day after day. So I had a good start. And then, early this morning, I got a similar list passed along to me, including all I had, plus a few. Some I can’t verify yet. I and people like me just want to know, Do we get to keep our country and our freedoms? We’re interested, so we keep searching for true news, wherever we can find it. And right now the news is coming at us like a firehose.

 

The Texas Lawsuit

The biggest story, especially living here in Texas, is about the Texas lawsuit against Pennsylvania, Georgia, Michigan, and Wisconsin, filed late near midnight Monday.

Texas Attorney General Ken Paxton’s Office put out this statement: 

“Trust in the integrity of our election processes is sacrosanct and binds our citizenry and the States in this Union together. Georgia, Michigan, Pennsylvania and Wisconsin destroyed that trust and compromised the security and integrity of the 2020 election. The states violated statutes enacted by their duly elected legislatures, thereby violating the Constitution. By ignoring both state and federal law, these states have not only tainted the integrity of their own citizens’ vote, but of Texas and every other state that held lawful elections,” said Attorney General Paxton. “Their failure to abide by the rule of law casts a dark shadow of doubt over the outcome of the entire election. We now ask that the Supreme Court step in to correct this egregious error.”  

Back in September we had a series on the Constitution. When we covered Article 3, the Judicial Branch, we noted that in Section 2, the Supreme Court is not just the ultimate appeals court. In certain circumstances it is the court of original jurisdiction. One such situation is when one or more of the states is a party in the suit.

So this Texas case goes directly to the Supreme Court. No stops along the way for a lower court to hear it or reject it. This case is “outcome determinative,” meaning that this one case could determine effect on the outcome of the election, since enough electors are involved. Whereas cases involving individual states would not, by themselves, determine outcome, because their electors alone would not make enough difference.

However, the Supreme Court is not being asked to determine the winner of the election. If it determines that the states indeed broke the law in ways that affected Texas and other states, the Constitution outlines possible alternatives. The first is for those state legislatures to meet and select a slate of electors. They would be free to select either candidate, although all of the states in question (plus AZ and NV, who are also swing states with voter fraud issues) have Republican-majority state legislatures.

If states fail to send electors and neither candidate thus gets 270 electoral votes, then the alternative approach is for the US House to vote—with a single vote from each state, based on its majority delegation. Timing changes the exact numbers, because Republicans have gained in the November election. If such a vote happens after seating the new Congress, then Republicans have 27 to Democrats’ 22, or something similar. If done with the existing Congress, Republicans still lead by a couple.

As of yesterday, 17 states had signed on to the Texas case. Today I have heard the numbers 18, 19, and 25, but I haven't been able to verify more than 17. Also, President Trump is joining in this lawsuit as a direct interested party. There are various ways to join the suit—to become additional equal plaintiffs, or to offer amicus briefs, and probably other ways. I don’t know which states have done what. Arizona has also offered an amicus brief stating that they believe the Supreme Court must take the case, since there is no lower court to remand it to. Justices Alito and Thomas seem to agree, based on what they've said previously.

SCOTUS has asked for responses by this afternoon (Thursday), so we should know what those contain by Friday.

Frei starts with this:

And let me tell you something: This is a well-drafted lawsuit. It is an election lawsuit, and the next time someone tells you that there were no voter irregularities anywhere in this election, tell them to read this lawsuit or watch this vlog, because they simply don’t know what they’re talking about or they work for CNN.

He adds that it is “challenging the Supreme Court to take action on the issue.” And he points out that the lawsuit focuses on these states’ breaking the law—both their own state laws and the US Constitution. Then it lists the damage done to faith in the outcome, using the most provable of claims that require only known data, not speculation.

One main point is that each of these states changed voting laws without the legislature; election law is required by the US Constitution to be set by state legislatures. I think in one case a state had a legislative change, but the change went directly against that state’s own constitution.

YouTube Censorship

The next big story, coincidentally, is that YouTube announced a new censorship policy.

·         “YouTube to Delete Content Alleging Presidential Election Fraud” by Jack Phillips for The Epoch Times, Dec. 9, 2020. 

As of yesterday, any video that makes the claim that the election is not settled will be taken down for being false. They claim that, because December 8th was the “safe harbor” day, a week before the scheduled Electoral College vote, when electors are appointed and given time to be prepared for their vote, that all is settled. Note that nothing in law mentions a “safe harbor” date. The date of the Electoral College vote is in statute but goes unmentioned in the Constitution. Only the January 20 inauguration date is mentioned (and that isn’t original either; it has been as late as April).

YouTube ignores all the cases that are making the electors in as many as six swing states unsettled. But if you argue with them, you will be silenced.

In essence, because their censorship policy coincides with the very substantial Texas case, they may be silencing news about an active, pressing, even historic Supreme Court case. 

There is quibbling, however. Joshua Philipp described it in his December 9 Q&A. He says, by his reading, it looks like you can say that Trump won the election. And you can say that there were voting irregularities. But if you tie those ideas together to say that voting irregularities mean that Trump really won the election, you will be censored.

On the R&R Law Group vlog  Wednesday, Robert F. Gruler tried to describe YouTube’s EDSA rules (educational, documentary, scientific, or artistic). YouTube’s example was that of a documentary that included speech by Nazi Germans; taken in context, that could be allowed, because it is used to show history, not to promote Nazism. Gruler, in applying that to the current election f-word (fraud), believes he can present information from original sources and offer some analysis of that, but would not be allowed to offer conclusions based on that analysis that go against YouTube’s assertion that the election outcome is settled.

That means you can still find videos on YouTube, ones where content producers are being very careful. But just in case, they’ll probably all tell you they’re pursuing other platforms, such as Rumble, Twitch, Facebook, Twitter, and probably others. I’ve been trying to navigate YouTube alternatives, but not yet successfully. I think that is going to be inevitable, though. I’ve been trying to learn to navigate MeWe and Parler as well, as alternatives to Facebook (see the story below), but I find them difficult and unsatisfying so far. Maybe it’s an age thing. I’m also aware that Blogger is a Google app, and that means I may eventually face scrutiny even here.

 

Facebook Monopoly

Meanwhile, Facebook is being forced to divest some of the companies it has acquired. By buying up any small competitor, it has essentially made itself a monopoly. The FTC lawsuit is asking that Facebook sell off Instagram and WhatsApp, and possibly others. The pressure for this case has been building for a decade, but only recently has scrutiny been paid to the control social media is exerting on the information people can get and share.

What I don’t know is whether that is significant in the ways people are hinting. The chatter added that there’s a lot of military air traffic, causing people to speculate all kinds of things. Another odd story came in a text passed along from a friend, but she could not identify the originator. Here are the main parts, copied as is:

The Kraken is SOF directed against domestic enemies who committed the election theft of 2020. This Kraken is needed because the CIA was running a rogue ELECTION THEFT!!!! operation out of our US Consulate office in Frankfurt Germany starting Tuesday, November 3rd, 2020. This is similar to the dozens of other election theft ops that the CIA has conducted in other countries around the world, very illegal then and now. Americans got a taste of what its like to be fraked by the CIA. Something many countries around the world already know. The US Army command was ordered by DoD and Trump to go in to Frankfurt and seize the CIA's own servers as evidence of the theft. The US Army did NOT raid Scytl's Frankfurt operation, that story is a ruse. The US Army seized American servers. We own them. We retrieved our own servers from a rogue CIA Election Theft Operation (similar to Hammer/Scorecard). Now President Trump has the servers….

This news will bring down the CIA, FBI, all of the major news organizations Washington Post, New York Times, Wall Street Journal, all of the television media, ABC, CBS, NBC, CNN, FOX, all of the tech titans Facebook, Twitter and especially Google. Foreign governments in Canada (PM Justin Trudeau), in United Kingdom (PM Boris Johnson), in France (President Emmanual Macron), in Germany (Chancellor Angela Merkel) and even the entire European Parliament will collapse. Trump has encrypted calls of John Brennan and Chris Way [sic] commiting sedition. Trump has encrypted communications between Speaker of the House Nancy Pelosi and Senator Chuck Schumer commiting sedition. Trump has information proving that dozens of Congress people, Senators and Governors all around America have committed election fraud and sedition. Trump has all the information and evidence needed to prove that CNN, FOX, Facebook, Twitter have all conspired to steal this election from the American people. President Trump has all of this information. How? Trump controls the NSA and the NSA has everything. Trump has everything because the NSA has everything. BOMBSHELL INDEED!

I’ve heard enough elsewhere that I believe the CIA servers were seized in Frankfurt. And quite possibly Kraken is the name of a military intelligence unit; I’m uncertain how to verify that, but I've heard it from multiple places. I don’t know about any of the rest of it. Is it wishful thinking that we could take down all the anti-America conspirators? Probably. But then, who knows? It’s the year 2020, after all.

Anyway, it has been a rather heavy news week. It’s still a challenge to wade through to find truth. But, until the censors become completely successful, at least we can still try to do that.

Days That Live in Infamy

This is the 79th anniversary of the attack on Pearl Harbor, which led to our entrance into World War II. It was an attack on our nation, on American soil. We still remember it, mark the day, and honor those who died there and who fought thereafter. There was a good movie last year about that attack and the months that followed, called Midway. It’s not the only movie about this event. And who knows what stories will recount the event in the future. I heard that this was the first year that survivors did not attend a memorial service in the nation’s capital. There are still a few survivors alive today, but because of the pandemic, or whatever reason, they did not travel to the event. Still, the the attack on Pearl Harbor remains clear in our collective memory. It woke us up to the threat to our freedom from those who would overthrow our country, our Constitution, and impose tyranny upon us. With God’s help, they did not win.

Another day that lives in infamy is September 11, 2001, when terrorists attacked the World Trade Center with airplanes, and also the Pentagon, and a fourth attempt taken down by heroic passengers before it could attack somewhere in the nation's capital. We responded with war beyond our shores, in the countries that supported the attackers, carrying that on until this year. This attack on American soil also woke us up to the threat to our freedom from those who would overthrow our country, our Constitution, and impose tyranny upon us. While that threat is not gone, in the past few years it has been decimated.

I think we have another day that will live in infamy—if our nation survives it: November 3, 2020. This attack on American soil ought to wake us up to the threat to our freedom from those who would overthrow our country, our Constitution, and replace it with tyranny. We don’t yet know the outcome. But I think we know what happened.

It’s hard to catalog all the cases. The Epoch Times has done a good job of distilling the various types of fraud in the various places into an infographic. (Joshua Philipp also goes through the information on this infographic on an episode of Crossroads.)

Another large detail this week was the hearing in Georgia in which security footage showed that, after the observers and media were cleared out, several workers pulled out ballots from under tables and spent a couple more hours counting them, unobserved. The video corroborated testimony contained in multiple affidavits.

The complicit media followed up by saying the accusations were debunked; nothing to see here. Erick Erickson,  who was a reliable conservative until he became a never-Trumper, parroted those talking points. I guess people believe what they want to believe. Buck Sexton pointed out the various debunking claims, which don’t line up and can’t simultaneously be true.

Earlier today Mollie Hemingway put out an excellent piece going through the debunking—and destroying it. Pretty much the only thing they were able to “debunk” was that what were referred to as “suitcases” containing votes, because they had handles and wheels, as we could see on the video, were actually “containers” used to carry votes. OK. We still don’t know why they were pulled out from under tablecloth-covered tables only after all the watchers and media left the area. You can’t throw out the whole story because you prefer a different word be used for what we saw on a video. Please read the rest of her very thorough piece.

Another possibly major detail this week is that, over the weekend Trump’s legal team was allowed to do a full forensic audit of the Dominion machines in Antrim County, Michigan. They were given eight hours on Sunday of access to the machines. And they expect to be able to report their findings about 48 hours after that. So we’re looking at hearing something by Wednesday. The machines are supposedly set up so that they do not leave a trace—logs are erased after changes are made. But the digital forensic technicians seem to believe they can still find evidence of the inserted votes, switched votes, and deleted votes. If the evidence is found in the Michigan machines, that opens up the need for such a forensic audit of all such machines—at least in the contested states, and possibly others as well.

One other thing to be aware of is timing. We’ve been looking at December 14th as something of a deadline, with the week before as a “safe harbor” date, meaning it gives Electors enough time to be prepared for the December 14th Electoral College voting. Sidney Powell said this: 

We have at least until Dec. 14. We might file more suits. The court in Michigan or Wisconsin today just gave us a great order recognizing that. These are not pure election contests we are filing. These are massive fraud suits that can set aside the results of the election due to this fraud at any time. The states should not be certifying election results in the face of it.

But Electors can only vote if their state has resolved voting disputes. If they cannot, then, if they act in time, state legislatures can send their own slate of Electors. If they simply fail to certify Electors—meaning the vote in that state is still in question—and no one receives 270 valid electoral votes, then in early January, the House votes, one vote per state, as prescribed by the Constitution for such a time as this. It may be that even that is not the last date. If the forensics show without a doubt that the election was stolen, remedy must be made; a fraudulent actor cannot be installed as our President.

It’s a tough road. It requires resolve on the part of many people—including Supreme Court justices, who would rather not be put in the arbiter position.

But the alternative is dire.

In a Verdict podcast this weekend, Senator Ted Cruz was talking about what is likely to happen, not just related to the presidential election, but the Georgia senatorial races. He said, 

Here’s what I believe will happen with a Biden/Schumer/Pelosi government. I think they’ll end the filibuster, which means there is no ability of the minority to stop the most radical policy proposals they put forward. I think they will pass a massive tax increase—not just repealing the Trump tax cut, but massively increasing taxes. I think they will pass all or major components of the Green New Deal, which will be absolutely crushing to small businesses and jobs. I think they will grant amnesty to every single illegal alien in America and try to make them voters as quickly as possible….

And I think they will add two new states to the union. They will add the District of Columbia and Puerto Rico, because they believe they’ll elect four Democratic senators immediately. Which means we could start January with 50 Democratic senators and end the year with 54.

And this is all about power. This is about locking in their power. And I believe, if we lose these two Georgia seats, I believe that the Democrats will pack the US Supreme Court. They’ll put on four radical judicial activists.

Larry Arnn, president of Hillsdale College was interviewed by Patrick Bet-David on Valuetainment, and shared his concern about the possible permanent changes:

Patrick Bet-David: Is there the possibility of what Reagan said, many years ago, that we’re one generation away from losing our freedom? Is that really something that applies to where we are today, where we can really dramatically change the face of America in one election?

Larry Arnn: Yeah. I’ve been thinking that’s coming for a long time. I think it’s here. You know, these things that we’ve been talking about, they will change the structure of the nation and make it very difficult for ordinary people to have any influence on that.

And here’s something. You know, the intensity of the political debate is like the 1850s. Violence in the streets. Completely divergent views about the Declaration of Independence, it’s meaning, and the Constitution. But now there’s something new. And that is, all of the establishment, all of the people who are in the best and most privileged places—they’re all in agreement with each other. And it’s just breathtaking to watch how uniform and predictable are the things that are said in the media and the things that are said in the academy.

I may have used this scripture, but I’ve been thinking of it since it came up in our scripture study reading recently: Ether 8:23-24. An ancient civilization is ending. We are being told their story by the man who abridged their story while his civilization is ending nearly a millennia later, speaking to those of us in our day who will read these words. He’s warning of the “secret combinations,” the corrupt collusion, that has led to the demise of both of these civilizations. I highlighted the phrases that especially strike me today:

23 Wherefore, O ye Gentiles, it is wisdom in God that these things should be shown unto you, that thereby ye may repent of your sins, and suffer not that these murderous combinations shall get above you, which are built up to get power and gain—and the work, yea, even the work of destruction come upon you, yea, even the sword of the justice of the Eternal God shall fall upon you, to your overthrow and destruction if ye shall suffer these things to be.

24 Wherefore, the Lord commandeth you, when ye shall see these things come among you that ye shall awake to a sense of your awful situation, because of this secret combination which shall be among you; or wo be unto it, because of the blood of them who have been slain; for they cry from the dust for vengeance upon it, and also upon those who built it up.

I know that I have been awake to some of it—the injustices, the wrongness of things—for a good part of my adult life. I know I have felt the urgency of this message through more than the past decade. I have been sharing what I believe is true. Is it enough? I don’t know.

So, the question is not whether there was voter fraud; there was. The question is not whether there was enough voter fraud in enough places to change the outcome from Biden to Trump; there was. The question is whether or not we will allow such things to be among us, leading to our destruction.

What I think we’re seeing play out is a connection between the massive voter fraud of the November 3rd election and the massive corruption that has been attempting to overthrow our government for some time. Take note of the now-proven corruption detailed in the Carter Page lawsuit and the Michael Flynn case—both of which were engineered by bad actors within our government against individual Americans for the purpose of staging a coup against our duly elected President Trump. Those who would do that collusion and corruption have not ceased.

If President Trump is successful in overcoming the election fraud, there will be a chance of uncovering the corruption and rooting it out. If he is unsuccessful, then I do not see a way back. We will be living under a full and totalitarian tyranny in a shockingly short time.

Some of the worst can be staved off temporarily if the two Senate races in Georgia go to Republicans—although, note that we already know we can’t trust the voting system in Georgia. Losses there would mean Democrat-run House, Senate, and Presidency, meaning they can go ahead unhindered. A Republican-majority Senate would mean they could stonewall some legislation. These two races need to be won even with a President Trump, to avoid more impeachment shenanigans, which would not be blocked by a Republican Senate.

I hope we are awake to our awful situation. I hope there are enough of us—because clearly a majority of us voted to retain freedom—who will stand firm against this encroaching darkness. Keep praying for the President, for his legal team, and the people’s legal teams, and for those brave individuals who have stepped up to testify to the fraud, at sometimes great personal risk. Pray for judges to have clarity and resolve to maintain the rule of law that keeps us free. 

The time is getting short. But it’s still unimaginable to me that this much injustice can be allowed in America. When a burden is too big, too heavy for me to carry, I ask God to carry it. And I’m doing that now. Pray with me that this infamous November 3rd date will live in infamy as yet another unsuccessful attempt to destroy our country.

A Tribute to Walter Williams

The world lost a great man Wednesday morning, December 2: economist Walter E. Williams. He was 84. His death was sudden and unexpected; he had taught class, as usual, the day before. He'd always hoped to go that way.

Next to Thomas Sowell, he is the economist I read and quote most. Thomas Sowell wrote a tribute to him today, mentioning even in the title that they were best friends. Sowell is now 90. He didn’t expect Williams to go first. He said,

He was my best friend for half a century. There was no one I trusted more or whose integrity I respected more.

Since he was younger than me, I chose him to be my literary executor, to take control of my books after I was gone. But his death at age 84 is a reminder that no one really has anything to say about such things.

Sowell mentions two of the books Walter Williams wrote (he wrote ten), which will always be worth reading:

Walter Williams, along with Thomas Sowell, is both black and conservative. Both grew up poor, Williams in the projects of Philadelphia, and then gained credibility through sheer genius combined with excellent research and communication skills. They have both street cred and scholastic credentials to say what their conclusions are, based on research, when it goes against the current political script. I have always thought of both of these men as great economists, great writers, and then notice they happen to be black. It’s handy that their skin color would give them the ability to challenge race assumptions that others would be called racist for stating.

I first discovered Walter Williams, I believe, when he substituted for Rush Limbaugh on the radio, and then started seeking his weekly column at Townhall or The Daily Signal.

In my tribute today, I’ll share what I’ve collected of his words. First come the quotes; I give sources where I have them. After that are the articles. There are places to find the entire archive of his weekly columns. The ones I’m listing are those I saved to my personal files because I wanted to keep them.

I don't think that stupidity, ignorance or insanity explains the love that many Americans hold for government; it's far more sinister and perhaps hopeless.

I'll give a few examples to make my case. Many Americans want money they don't personally own to be used for what they see as good causes such as handouts to farmers, poor people, college students, senior citizens and businesses. If they privately took someone's earnings to give to a farmer, college student or senior citizen, they would be hunted down as thieves and carted off to jail. However, they get Congress to do the identical thing, through its taxing power, and they are seen as compassionate and caring. In other words, people love government because government, while having neither moral nor constitutional authority, has the legal and physical might to take the property of one American and give it to another.—"Americans Love Government” June 10, 2009

 

Political decision-making and allocation of resources is conflict enhancing while market decision-making and allocation is conflict reducing. The greater the number of decisions made in the political arena, the greater the potential for conflict…. If European governments and the U.S. Congress ceased the practice of giving people what they have not earned, budgets would be more than balanced. The fact that the civil rights struggle is over and won does not mean that there are not major problems confronting many members of the black community, but they are not civil rights problems and have little or nothing to do with racial discrimination.—“Blacks and Obama” December 4, 2013

 

People who denounce the free market and voluntary exchange, and are for control and coercion, believe they have more intelligence and superior wisdom to the masses. What’s more, they believe they’ve been ordained to forcibly impose that wisdom on the rest of us. What goes unappreciated is just why America's leftists' movement attacks the Founders. If they can delegitimize the Founders themselves, it goes a long way toward their agenda of delegitimizing the founding principles of our nation. If the leftists can convince the nation that men such as George Washington, Thomas Jefferson and James Madison were good-for-nothing slave-owning racists, then their ideas can be more easily trashed.—“Undermining America” October 28, 2017

Let me offer you my definition of social justice. I keep what I earn and you keep what you earn. Do you disagree? Well then tell me how much of what I earn belongs to you—and why?

How does something immoral, when done privately, become moral when it is done collectively? Furthermore, does legality establish morality? Slavery was legal; Apartheid is legal; Stalinist, Nazi, and Maoist purges were legal. Clearly, the fact of legality does not justify these crimes. Legality, alone, cannot be the Talisman of moral people.

 

Prior to capitalism, the way people amassed wealth was by looting, plundering and enslaving their fellow man. Capitalism made it possible to become wealthy by serving your fellow man.
